The Company shall not be liable for any claims, liability (direct / indirect) or damages in this regard, should such an eventuality arise as a result of the Company sharing the information provided by You with the assigned Cook. The Company reserves the right to use, with or without your prior consent, the information provided by You for the purpose of gathering market intelligence including but not limited to customer survey, analysis of customer data, customer data, marketing press releases, etc. The Company reserves the right to offer, at its sole discretion as it may deem fit, third-party services and products to you based on the preferences that you identify in your registration and at any time thereafter; such offers may be made by the Company or by third parties. You agree and acknowledge that the Company may use your contact information to provide or update You regarding promotion events of the Company, new offers, renewal reminders, payment reminders, feedback, opinion etc and the same shall not be treated as “spam” or un warranted “marketing” calls. Without limiting any of the other disclaimers of warranty set forth in these Terms of Use, the Company does not provide or make any representation as to the quality or nature of any of the third-party products or services, as applicable, purchased through the Cookdocook.com or any other Cookdocook.com Site, or any other representation, warranty or guaranty.
4. USE OF THE COOKDOCOOK.COM SERVICES
Permitted Use
The CookDoCook.com platform is operated solely for facilitating domestic cooking services by introducing independent cook service providers to customers. The services may be used only by individuals seeking cooking services for personal household use and by cook service providers seeking engagement opportunities through the platform.
Use of the CookDoCook services is subject to these Terms and any additional agreements executed between the User and the Company. In the event of any inconsistency, the terms of such specific agreement shall prevail.
Limited Information Sharing Policy Notwithstanding anything contained elsewhere in these Terms:
a) CookDoCook shall share only limited information of the cook, strictly on a need-to-know basis, which shall be confined to:
Full name of the cook; and
One valid Government-issued identity proof, in masked or limited form, as permissible under applicable laws.
c) The User expressly acknowledges that CookDoCook acts only as a facilitation platform and does not guarantee, certify, or warrant the personal background, conduct, skill level, or suitability of any cook beyond the limited information disclosed.
4.3 Prohibited Use
- Users agree not to misuse the CookDoCook platform or services in any manner, including but not limited to:
- Using the platform for any unlawful, fraudulent, misleading, defamatory, abusive, obscene, or harmful purpose;
- Attempting to collect, extract, solicit, store, or misuse any personal information of cooks beyond what is expressly shared by CookDoCook;
- Demanding or coercing CookDoCook to disclose additional personal, professional, or sensitive information of cooks;
- Impersonating any individual or entity or misrepresenting identity or intent;
Uploading, transmitting, or sharing any content containing malware, viruses, or harmful code;
- Using the platform to solicit unrelated services, advertise, promote, or conduct commercial activities without written authorization from the Company;
- Interfering with the security, integrity, or functionality of the CookDoCook website or systems, including unauthorized access attempts;
- Copying, scraping, reproducing, or misusing any content, data, or information available on the platform;
- Reverse engineering, decompiling, or attempting to derive the source code of the platform or its systems;
- Linking, framing, or embedding CookDoCook content without prior written consent.
4.4 Data Protection & Privacy Acknowledgement
Users acknowledge and agree that:
- All information shared by CookDoCook is proprietary and confidential;
- Such information shall be used only for the limited purpose of availing cooking services;
- Any unauthorized use, disclosure, or misuse shall attract civil and/or criminal liability under applicable laws, including data protection and privacy laws.
4.5 Suspension & Legal Action
In case of breach or non-compliance with this Section:
CookDoCook reserves the absolute right to suspend or terminate access to the platform, remove content, and initiate appropriate legal proceedings against the offending User, without any liability for such action.
4.6 No Liability
CookDoCook shall not be liable for:
Any act, omission, misconduct, or negligence of the cook;
Any consequences arising from reliance on limited information provided;
Any dispute between the User and the cook.
5. USER CONTENT AND SUBMISSIONS
- You agree and acknowledge that you are solely responsible for your account information, content, messages or other information ("User Content") that you submit, publish or display on any Cookdocook.com Site or transmit to other Users. By posting User Content to any Cookdocook.com Site, you automatically grant, and You represent and warrant that You have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such User Content and to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorize sublicenses thereof.
- By posting User Content to any public or non-public area of any Cookdocook.com Site, including message boards, forums, contests and chat rooms, You grant the Company and its affiliates the loyalty-free, perpetual, irrevocable, sublicense able (through multiple tiers), non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the User Content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content. - The Company acts as a passive conduit for the online distribution and publication of User Content and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring User Content posted by Users. However, the Company may review and delete any User Content that, in the sole judgment of Cookdocook.com, violates these Terms of Use, violates applicable law, rule or regulation, is offensive or illegal or violates the rights of, harms or threatens the safety of Users of any Cookdocook.com Site. The Company reserves the right to expel Users and prevent their further access to the Cookdocook.com Sites for violating the Terms of Use or applicable law, rule or regulation and the right to remove User Content which is in violation of the Terms of Use, abusive, illegal, or disruptive. The Company reserves the right to archive the user content folders which were not being accessed for a period of 6 months or more by the relevant users after its last access. In such event users will be able to access the archive folders with minor limitations including but not limited to non-availability of the options of move to another folder, renew jobs associated with the said folders. The Company may take any action with respect to User Content that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its ISPs or other suppliers.
- Cookdocook.com reserves the right, in its sole discretion, to investigate and take legal action against any User who engages in any illegal or prohibited conduct or otherwise violates these Terms of Use, including without limitation removing the User Content from the Cookdocook.com Sites and/or terminating the offending User's ability to access the Cookdocook.com Sites and/or use Cookdocook.com services. The Company may take any other action with respect to User Content or User actions that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its ISPs or other suppliers.

7. DATA SHARING, PRIVACY & LIMITED DISCLOSURE (DPDP ACT, 2023 COMPLIANT)
Role of CookDoCook
CookDoCook acts as a digital facilitation platform and is a Data Fiduciary under the Digital Personal Data Protection Act, 2023 (“DPDP Act”). The client/user acknowledges that CookDoCook collects and processes personal data strictly for the purpose of enabling cooking services.
7.2. Restricted Data Disclosure
In strict adherence to the principles of purpose limitation and data minimization under the DPDP Act:
- Pre-Booking Anonymity: No personal information or identity details of the Cook shall be disclosed to the Client during the enquiry or initial selection stage.
- Post-Booking Disclosure: CookDoCook shall share
the complete details of the assigned Cook, including their full name,
photograph, and valid Government-issued identity proof, exclusively
after the booking is formally confirmed and the work is assigned.
Client Obligations as Data Recipient
The client agrees that:
The information shared shall be used solely for verification and service-related purposes;
The data shall not be stored, copied, circulated, published, or shared with any third party;
Any misuse, unauthorized disclosure, or retention beyond purpose shall be the sole responsibility of the client and may attract liability under the DPDP Act, 2023.
Consent & Lawful Processing
The user acknowledges that the limited sharing of personal data is done based on lawful consent and for a legitimate purpose as defined under the DPDP Act, 2023.
No Guarantee or Verification Warranty
CookDoCook does not warrant, certify, or guarantee the accuracy, completeness, or suitability of any personal data shared and shall not be liable for any act, omission, or conduct of the cook.
Right to Restrict or Withdraw Access
CookDoCook reserves the right to restrict, mask, or withhold any personal data or terminate access to services in order to ensure compliance with applicable data protection laws or platform policies.
Data Retention & Deletion
CookDoCook shall retain personal data only for such period as necessary to fulfil the stated purpose or as required under applicable law and shall delete or anonymize the same thereafter.
8. DATA PRIVACY AND SMS ALERTS
In the context of the 'alerts' service being offered by Cookdocook.com, the Customer consents to the use of their personal data in the form of cellular phone number(s) by Cookdocook.com to send booking confirmations, service updates, and other relevant information as and when they become available.
9. POLICY REGARDING TERMINATION OF USERS WHO INFRINGE THE COPYRIGHT OR OTHER INTELLECTUAL PROPERTY RIGHTS OF OTHERS
Cookdocook.com and its affiliated companies respect the intellectual property of others, and we ask our users, account holders and content partners to do the same. The unauthorized reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners’ rights. As a condition to your use of Cookdocook.com, You agree not to use Cookdocook.com or any other Cookdocook.com Site to infringe the intellectual property rights of others in any way, directly or indirectly. We at our sole discretion, will terminate the accounts of any Cookdocook.com.com account holders, and block access to Cookdocook.com and/or the other Cookdocook.com Sites of any Users who to the knowledge of Cookdocook.com are infringers of the copyrights, or other intellectual property rights, of others. 10. MEAL, VISIT & SERVICE UNDERSTANDING POLICY
Definition of “One Meal”
For the purpose of service estimation and operational clarity, “One Meal” is defined as the preparation of all the following staple items:
- Breads: Rotis, Chapatis, or Parathas
- Rice
- Gravy: Dal or Curry
- Side Dish: One Sabzi (Vegetarian or Non-Vegetarian)
The exact menu items, quantities, combinations, cooking methods, and ingredients may vary daily based on customer instructions, preferences, and ingredients provided. This definition is indicative only and shall not be construed as a fixed or guaranteed menu.
Meal Preparation Time – Indicative Only (Per Visit Basis)
- All preparation time estimates are calculated per visit, not per day.
- Actual preparation time may vary depending on:
- Menu complexity
- Number of dishes
- Vegetarian or non-vegetarian preparation
- Ingredient readiness
- Kitchen layout, equipment, and utilities
- Breakfast Meal Definition & Scope ● If the meal selected is Breakfast , it does not include preparation of:
○ rotis / chapatis ○ dal ○ rice ○ regular sabzi ● Breakfast includes only breakfast-specific items , as instructed by the customer. ● Breakfast items may include , but are not limited to: ○ paratha ○ idli–sambar ○ dosa ○ sandwich ○ omelette ○ poha ○ upma ○ and similar breakfast preparations ● Breakfast is treated as a separate meal category and cannot be compared with lunch or dinner meals in terms of items or preparation. ● The exact breakfast items and quantity will depend on: ○ customer instructions, and ○ ingredients arranged by the customer.

- The cook’s responsibility is limited to cooking using ingredients made available by the customer.
Ingredient Readiness – Mandatory Customer Obligation
- Customers must ensure that all required
ingredients are:
- Available
- Cleaned (where applicable)
- Kept ready before the cook arrives
- Cooks operate on back-to-back schedules.
- Any delay due to:
- Missing ingredients
- Late grocery arrangement
- Incomplete preparation
may: - Increase overall cooking time, and
- Impact subsequent bookings.
- Cook Do Cook shall not be responsible for delays caused due to ingredient unavailability.
Visit Timings & Scheduling
- Visits are scheduled within preferred time slots, not fixed exact times.
- A ±15-minute flexibility window applies due to traffic or previous bookings.
- Minor delays shall not constitute service deficiency.
Communication & Coordination Rules
- Customers shall not directly negotiate, alter timings, or modify service scope with the cook.
- All service changes, complaints, or timing adjustments must be routed only through Cook Do Cook Customer Support.
- Direct coordination with cooks for service modification is strictly prohibited.
Access, Safety & House Rules
- Customers must not hand over house keys to the cook under any circumstances.
- The cook shall be provided access only to the kitchen or designated cooking area.
- The customer is responsible for ensuring a safe, respectful, and functional environment.
Kitchen & Utility Readiness
Customers must ensure that the following are functional and ready prior to the cook’s arrival:
- Gas connection
- Stove
- Utensils
- Basic cooking utilities
Delays caused due to unprepared kitchen conditions may impact service time and future bookings.
Paid Leave, Absence & Replacement
This option creates a clear distinction between the entitlement (4 days), the process (discussion), and the contingency (replacements).
1. Paid Leave, Absence & Replacement
1.1. Paid Leave Entitlement: The Cook is entitled to a maximum of four (4) paid leaves [per month/per billing cycle].
1.2. Scheduling: The specific dates for these leaves shall be discussed and mutually agreed upon directly between the Client and the Cook.
1.3. Unplanned Absence & Replacements: In the event of any absence beyond the agreed paid leaves, or if a replacement is required:
- The Client must be duly informed; and
- Any replacement or service adjustment shall be handled solely by CookDoCook. The Client shall not make private arrangements for replacements.
Complaints, Conduct & Service Termination
- Reporting of Service Issues Any service issue, complaint, or grievance must be reported to CookDoCook within twenty-four (24) hours of the occurrence. Reports made after this period may impact our ability to resolve the issue effectively.
- If a cook raises a complaint against a customer, the Company shall investigate.
- In cases of serious misconduct (including misbehaviour,
harassment, unsafe environment, or house-rule violations):
- Service may be immediately terminated, or
- The cook may be replaced, at the Company’s discretion.
- Repeated complaints against a customer may result in:
- Permanent service discontinuation, and
- Blacklisting from future services.
- Cook Do Cook reserves sole authority to evaluate complaints and take appropriate action.
Cook Safety & Repeated Concerns – Replacement and Termination
Where an assigned Cook reports a genuine concern relating to safety, harassment, abuse, misconduct, or unhygienic working conditions at a particular household, the Company reserves the right to replace the Cook with immediate effect and without prior notice to the Customer.
Where a second, independently assigned Cook subsequently reports a similar genuine concern regarding the same household, and the Company, upon reasonable assessment made in good faith, determines that the concern cannot be resolved, the Company may terminate the booking with immediate effect to safeguard the safety and well-being of its service professionals.
The Company's decision regarding continuation, replacement, or termination of service under this Clause shall be final, provided such decision is made on a reasonable assessment of the reported concerns and in good faith.
Final Authority & Binding Nature
All decisions relating to:
- Timings
- Replacements
- Service continuation
- Dispute resolution
shall be governed exclusively by Cook Do Cook policies, and the Company’s decision shall be final and binding.
Customer Obligations & Service Guidelines:
1. Access, Environment & Supervision
- Presence Required: A responsible adult must be present to grant entry and provide oversight. If the Cook cannot access the premises or receive instructions, the visit will be marked as a "No-Show" and is non-refundable.
- Workspace Conditions: Customers must ensure the kitchen is safe and accessible. Any specific constraints (e.g., induction-only, small spaces) must be communicated in advance. Pets must be secured to prevent interference with the cooking process.
- Instruction Protocol: Clear cooking instructions must be provided at the start of the visit. Modifications made mid-preparation may extend cooking time or require deferral to the next visit.
2. Scope of Service Restrictions
- Strict Exclusions: The Cook’s role is exclusively limited to food preparation. Customers shall not request ancillary tasks including, but not limited to, dishwashing, sweeping/mopping, babysitting, grocery shopping, or personal errands.
3. Financial Integrity & Liability
- Zero-Cash Policy: All payments must be routed strictly through the Cook Do Cook platform. Customers are prohibited from offering direct cash, tips, advances, or loans to the Cook.
- Asset Protection: Cook Do Cook acts solely as a facilitator. Customers are advised to secure valuables and personal assets; the Company assumes no liability for loss or misplacement of items.
4. Conduct & Dispute Resolution
- Professional Conduct: Mutual respect is mandatory. Harassment, abuse, or unprofessional behavior towards the Cook will result in immediate service suspension or termination.
- Grievance Timeline: Feedback or complaints regarding food or service quality must be reported within a reasonable timeframe (e.g., 24 hours) to ensure effective resolution. Delayed reports may limit our ability to investigate or remediate the issue.
Note: Repeated non-compliance with these guidelines may result in the temporary suspension or permanent termination of services.
11. BOOKING CONFIRMATION & SERVICE COMMENCEMENT POLICY
11.1. Non-Response & Booking Hold
- After a booking is made, Cook Do Cook may contact the Customer for confirmation, scheduling, or cook assignment.
- If the Customer does not answer calls or respond to communication attempts, the booking will remain on Hold.
11.2. Auto-Cancellation
- If the Customer remains unreachable or unresponsive until the end of the third (3rd) day from the booking date, the booking will be automatically cancelled.
11.3. Service Start Date
- Assignment Dependent: Cooking service will officially commence from the first scheduled day after a cook is successfully assigned, and not necessarily from the original booking date.
- No Backward Shifting: Any delay in the service start caused by the Customer’s non-response or unavailability shall not shift the service start date backward. The service period is considered active from the date the Cook was ready to be assigned.
12. LIABILITY OF THE COMPANY
12.1 Nature of Services
Cook Do Cook Private Limited ("CookDoCook") operates exclusively as a technology-enabled facilitation and discovery platform. The Company’s role is limited to connecting Customers with independent cook service providers ("Cooks"). CookDoCook is not a party to, nor holds any liability for, the service arrangement, contractual understanding, or engagement entered into directly between the Customer and the Cook. The Cooks operate as independent contractors and not as employees of CookDoCook.
The Services provided are strictly limited to food preparation. To ensure operational efficiency, the following terms apply:
- Exclusion of Cleaning Services: Utensil cleaning, dishwashing, and general kitchen cleaning are expressly excluded from the scope of the cooking service.
- Customer Obligation: It is the sole responsibility of the Customer to ensure that all necessary utensils are sanitary and readily available prior to the Cook’s arrival.
- Impact of Non-Compliance: CookDoCook and the
Cook reserve the right to limit service if utensils are unavailable or
unclean. Any delay resulting from a failure to provide clean utensils
may:
- Count towards the billable preparation time; and
- Result in the curtailment of service to prevent disruptions to the Cook’s subsequent scheduled engagements.
12.2 Independent Contractor Relationship
a) All Cooks registered or listed on the platform act strictly as independent contractors and not as employees, agents, partners, representatives, or servants of CookDoCook.
b) No relationship of employer–employee, principal–agent, partnership, joint venture, or master–servant is created between CookDoCook and any Cook by virtue of platform usage, onboarding, listing, or facilitation.
c) The Cook alone shall be responsible for the manner, method, timing, and execution of services rendered to the customer.
12.3 Sharing of Cook Information In accordance with these Terms and Conditions and applicable data protection laws, CookDoCook shall share Cook-related information with the customer strictly on a limited and need-to-know basis, as under:
a) Upon confirmation and assignment of work, the Cook’s photograph and one valid Government-issued identity proof may be shared through a mode acceptable to the customer.
b) CookDoCook shall provide a certificate confirming the Court Records Check of the Cook.
Exclusions: No resumes, detailed profiles, addresses, contact details, or other personal or sensitive information shall be shared (except as explicitly stated above).
12.4 No Verification or Performance Guarantee
While CookDoCook may conduct basic onboarding or platform-level screening formalities for operational purposes, the Company does not represent, guarantee, warrant, or certify the skills, conduct, character, integrity, background, reliability, fitness, or suitability of any Cook.
The customer shall independently satisfy itself before and during the engagement.
Further, To ensure accurate service calculation, children aged 12 and above are counted as additional persons for all bookings. In cases where age is unclear, Cook Do Cook reserves the right to request verification via a school ID or valid government-issued photo ID. This request is made solely for operational clarity; we strictly respect your privacy and ensure that identification details are never retained or misused.
12.5 No Employer, Agency, or Supervisory Liability
CookDoCook:
a) Does not employ, control, supervise, direct, or manage the Cooks;
b) Does not determine wages, working hours, work conditions, or service methodology;
c) Shall not be responsible or liable for any act, omission, negligence, misconduct, default, or breach committed by the Cook during or after the engagement.
12.6 Assumption of Risk by Customer
The customer acknowledges that engaging an individual for domestic or household services involves inherent risks. The customer agrees to exercise due diligence, caution, and supervision and assumes full responsibility for all interactions, dealings, and engagements with the Cook.
12.7 Limitation of Liability
To the fullest extent permissible under applicable law, CookDoCook shall not be liable for:
a) Any loss, injury, damage, theft, misconduct, deficiency, or dispute arising out of or in connection with the Cook’s services;
b) Any reliance placed on the limited information shared through the platform;
c) Any direct, indirect, incidental, consequential, punitive, or special damages, whether foreseeable or otherwise.
12.8 Release and Indemnity
The customer hereby irrevocably agrees to release, defend, indemnify, and hold harmless CookDoCook, its directors, officers, employees, and agents from and against all claims, liabilities, damages, losses, costs, or legal proceedings arising out of or relating to:
a) The engagement, conduct, or performance of the Cook;
b) Any breach of law, contract, or duty by the Cook or the customer;
c) Any dispute between the customer and the Cook.
12.9 Content Accuracy Disclaimer
CookDoCook does not warrant that any information, content, or material made available on the platform is complete, accurate, or error-free. All use of the platform and reliance on its content is at the customer’s sole risk.
12.10 Data Availability and Backup
CookDoCook shall not be responsible for any loss, deletion, corruption, or unavailability of user-related data, records, or communications, to the extent permitted under applicable law.
13. SAFETY, SECURITY, RISK & LIABILITY DISCLAIMER
- Independent Service Provider Risk: Cooks engaged through the Platform are independent third-party service providers, and are not employees, agents, representatives or partners of Cook Do Cook Private Limited (“the Company”). The Company does not supervise or control the conduct, behaviour, background, movement, activities, or actions of any cook at the Customer’s premises. The installation of CCTV or surveillance within the premises is acknowledged as a measure for the mutual safety and security of both the Client and the Cook. However, the Client agrees that such surveillance shall be used responsibly and shall not be used to threaten, intimidate, or harass the Cook in any manner.
- Customer Acceptance of Risk: By allowing any cook to enter and work inside the premises, the Customer voluntarily assumes full responsibility and risk associated with such access, including any risk to personal safety, property, reputation, data, or belongings.
- No Liability for Theft, Loss, Damage or Misconduct: The Company shall not, under any circumstances, be responsible or liable for any act, omission, behaviour or misconduct of any cook, including but not limited to:
Theft, Burglary Or Misappropriation Of Property
Loss, Destruction Or Damage To Assets Or Valuables
Financial Loss
Trespass Or Misuse Of Premises
Harassment, Misbehavior, Assault, Threats Or Abuse
Negligence, Mistake Or Wrongful Acts
Breach Of Trust Or Confidentiality
Violation Of Law Or Social Norms
Whether Such Incident Occurs During Or After Service Engagement
- Criminal or Civil Incidents: In the event of any alleged criminal or civil wrongdoing by a cook, the sole and exclusive right and responsibility to initiate legal, police, or remedial action shall rest with the Customer. The Company shall not be made a party to any dispute, investigation, litigation or proceedings arising therefrom.
- Verification Limitation: While the Company arranges background verification through third-party agencies, such verification is procedural in nature and does not constitute a guarantee, assurance, warranty or certification of the cook’s character, past record, reliability, integrity, behaviour, competence or law-abiding nature. The Company shall not be liable for any inaccuracy, limitation, failure, delay or omission in third-party verification processes.
- Strong Recommendation for Police Verification: The Customer is solely responsible for safeguarding life and property and is strongly advised to conduct independent police verification and due diligence of the cook prior to and during engagement. Any failure to do so shall be deemed as acceptance of risk by the Customer.
- No Vicarious Liability: Since the Company is not the employer or controller of the cooks, no vicarious liability, joint liability, contributory liability or supervisory liability shall arise against the Company under any law.
- Indemnity: The Customer agrees to fully indemnify, defend and hold harmless the Company, its directors, officers, employees, partners and agents from any claims, complaints, losses, damages, liabilities, proceedings, penalties, legal costs or expenses arising out of or connected with any act, omission, misconduct, negligence or behaviour of the cook.
- Service Limited to Facilitation Only: The Company’s role is strictly limited to platform facilitation, onboarding, verification coordination, payment facilitation and customer support. The Company does not assume any duty of care, fiduciary duty or protective obligation towards the Customer, household members, guests, staff, neighbours or property.
- Maximum Legal Protection Clause: To the fullest extent permitted by applicable law, the Company’s liability whether contractual, statutory, tortious or otherwise — is expressly excluded in relation to any incident occurring at the service location or arising from the cook’s engagement.
14. LIMITATION OF LIABILITY
14.1 General Limitation
To the maximum extent permitted under applicable law, Cook Do Cook Private Limited (“CookDoCook”) shall not be liable to you or any user for any use, misuse, inability to use, or reliance upon the website, mobile application, or services, for any damages whatsoever, including but not limited to direct, indirect, incidental, consequential, special, punitive, or exemplary damages, or damages for loss of profits, revenue, data, or use, whether arising in contract, warranty, tort (including negligence), intellectual property infringement, or any other legal theory, even if CookDoCook has been advised of the possibility of such damages. CookDoCook does not assume any legal liability or responsibility for the accuracy, completeness, suitability, or usefulness of any information, content, or material made available through the platform.
14.2 Statutory Extent
The limitations set forth herein shall apply notwithstanding the failure of any essential purpose of any limited remedy and shall apply to the fullest extent permitted under applicable law.
14.3 Acts or Omissions of Cooks
In no event shall CookDoCook be liable for any loss, damage, theft, misconduct, negligence, civil wrong, or criminal act committed by any Cook engaged through the platform at the customer’s premises or otherwise. The customer acknowledges and agrees that the Cook is an independent contractual service provider, and the customer shall be wholly and solely responsible for supervising and engaging with the Cook and cannot hold CookDoCook liable for the conduct or actions of the Cook. Customers are strongly advised to conduct independent verification, including police verification, of the Cook at their own discretion.
14.4 No Employer or Agency Relationship
CookDoCook is not the employer, agent, or representative of any Cook. If a customer agrees to engage the services of a Cook identified or facilitated through the platform, such engagement or agreement shall be solely between the customer and the Cook. CookDoCook shall not be a party to such agreement and shall bear no responsibility for its performance, enforcement, or breach. No employer–employee, principal–agent, partnership, joint venture, or similar relationship is created between CookDoCook and any Cook.
14.5 Third-Party Vendors Or Agencies
Where CookDoCook facilitates connections through third-party vendors or agencies, such vendors or agencies operate independently and outside the control of CookDoCook. Any onboarding, document collection, or screening claimed by such vendors is their sole responsibility.
All disputes, claims, or issues relating to:
conduct of the Cook,
quality of cooking services,
payments, or
any civil or criminal liability
shall be resolved directly between the customer and the Cook or vendor, as applicable.
CookDoCook expressly disclaims all liability arising therefrom.
14.6 Release, Indemnity, and Hold Harmless
By using the platform, you expressly agree to release, indemnify, and hold harmless CookDoCook, its directors, officers, employees, and agents from and against any and all claims, demands, losses, damages, liabilities, costs, or legal proceedings, whether known or unknown, arising out of or in connection with:
a) engagement or conduct of the Cook;
b) disputes between the customer and the Cook;
c) misuse of the platform or services;
d) violation of these Terms or applicable law.
14.7 User Responsibility and Reporting
Users agree to exercise reasonable caution and due diligence in all interactions with Cooks, particularly during offline engagement. Any suspected misconduct, impropriety, or misuse shall be promptly reported to CookDoCook through official communication channels.
14.8 Force Majeure / Uncontrollable Events
Cook Do Cook assumes no liability for service interruptions arising from circumstances beyond our reasonable control. This includes, but is not limited to, utility failures (power or gas), building access restrictions, labor strikes, natural disasters, or government mandates

The Company does not provide or make any representation as to the quality or nature of any of the third-party products or services purchased through any Cookdocook.com Site, or any other representation, warranty or guaranty. Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of such third-party products or services, under the terms agreed to by the provider.
17. INDEMNITY
You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to any Cookdocook.com Site, including for the purpose of Your use of any Cookdocook.com Content, or (ii) Your breach of these Terms. Cookdocook.com shall provide notice to you promptly of any such claim, suit, or proceeding.
18. TERM AND TERMINATION
- These Terms of Use will remain in full force and effect while you are a User of Cookdocook.com at any level. The Company reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of your User Content from Cookdocook.com and the other Cookdocook.com Sites and immediate termination of your registration with or ability to access Cookdocook.com and the other Cookdocook.com Sites and/or any other services provided to You by the Company, upon any breach by You of these Terms of Use or if the Company is unable to verify or authenticate any information You submit to Cookdocook.com or other Cookdocook.com Site registration. The Company shall have the right terminate Your registration in terms under this Terms of Use.

20. GENERAL
- ASSIGNMENT: You may not assign or sub-license the rights, duties or obligations under the Terms of Use, in whole or in part, to any person or entity without the prior written of Cookdocook.com.
- RELATIONSHIP BETWEEN PARTIES: It is expressly agreed that Cookdocook.com and You are independent contractors.
- GOVERNING LAW AND JURISDICTION: This Agreement and any disputes arising between You and Cookdocook.com shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872. The courts in Raipur, in the State of Chattisgarh, (India) shall have exclusive jurisdiction over disputes relating to the subject matter under this Terms of Use.
- SEVERABILITY AND WAIVER: Each paragraph of this agreement shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise indicated by the context of the agreement. The decision or declaration that one or more of the paragraphs are null and void shall have no effect on the remaining paragraphs of this agreement.
- PARAGRAPH HEADINGS: The titles to the paragraphs of this Agreement are solely for the convenience of the parties and shall not be used to explain, modify, simplify, or aid in the interpretation of the provisions of this Agreement.
- COUNTERPARTS: The Agreement may be executed in two or more counterparts, any one of which shall be deemed the original without reference to the others.
- ENTIRE AGREEMENT: The Terms of Use including the Cookdocook.com Privacy Statement constitute the entire agreement between You and the Company with respect to the use of Cookdocook.com site.
21. REFUND POLICY
Refund & Cancellation Policy – Cook Do Cook
General Principles & Definitions
Service Start Date: For the purpose of calculating refund timelines, the "Service Start Date" shall be defined as the date on which the Cook first reports to the Customer’s premises following the payment of the Booking Amount.
Active Booking: A booking is deemed "Active" only upon the successful receipt of the applicable Booking Amount by Cook Do Cook.
Strict Adherence: Refunds shall be processed solely based on the payment plan selected by the Customer and the strict timing of the cancellation request as detailed below.
21.1. Customer Cancellation – Trial Period
The following policy shall apply to cancellations made by the customer during the trial period:
a) Cancellation before twelve (12) hours remaining to the scheduled Service Start Date (Including Trial Day):
- 100% refund of the service/subscription fee, and
- 100% refund of the booking amount paid.
b) Cancellation within twelve (12) hours prior to the scheduled Service Start Date (Including Trial Day), after cook assignment:
- 50% refund of the service/subscription fee, and
- 100% refund of the booking amount paid.
Note: The convenience fee shall be strictly non-refundable in both of the above cases.
21.2. Customer Cancellation – Without Trial (Prior to Service Start)
The following policy shall apply to pre-commencement cancellations made by the customer for bookings without a trial period:
a) Cancellation before twelve (12) hours remaining to the scheduled Service Start Date:
- 100% refund of the service/subscription fee, and
- 100% refund of the booking amount paid.
b) Cancellation within twelve (12) hours prior to the scheduled Service Start Date, after cook assignment:
- 50% refund of the service/subscription fee, and
- 100% refund of the booking amount paid.
Note: The convenience fee shall be strictly non-refundable in both of the above cases.
21.3. Customer Cancellation – After Service Commencement
If the Customer cancels the service after the Service Start Date, the following strict refund tiers apply based on the chosen payment plan:
Scenario A: Partial Payment Plan
- (a) Cancellation on or before the 3rd Day of Service:
- Booking Amount: Refund applicable subject to a 30% deduction.
- Subscription Fee: Refund of 50% of the paid fee.
- (b) Cancellation after the 3rd Day but on or before the 7th Day
of Service:
- Booking Amount: Refund applicable subject to a 60% deduction.
- Subscription Fee: Nil (0%). The Subscription Fee is fully forfeited.
- (c) Cancellation after the 7th Day of Service:
- NO REFUND of any kind (neither Booking Amount nor Subscription Fee) shall be granted.
Scenario B: Full Payment Plan (Upfront Payment)
- (a) Cancellation on or before the 3rd Day of Service:
- Booking Amount: Refund applicable subject to a 15% deduction.
- Subscription Fee: Refund of 50% of the paid fee.
- (b) Cancellation after the 3rd Day but on or before the 7th Day
of Service:
- Booking Amount: Refund applicable subject to a 30% deduction.
- Subscription Fee: Nil (0%) The Subscription Fee is fully forfeited.
- (c) Cancellation after the 7th Day but on or before the 15th Day
of Service:
- Booking Amount: Refund applicable subject to a 50% deduction.
- Subscription Fee: Nil (0%).
- (d) Cancellation after the 15th Day of Service:
- NO REFUND shall be granted under any circumstances.
4. Failure to Assign Cook by Cook Do Cook
If Cook Do Cook is unable to assign a cook as promised for the booking:
- The customer shall receive a 100% refund of all amounts paid,
including:
- Service/subscription fee
- Booking amount
- Convenience fee
Note: The convenience fee shall be refunded only in cases where Cook Do Cook fails to assign a cook. In all other scenarios, the convenience fee remains non-refundable.
21.5. Cook No-Show After Assignment
If a cook has been assigned but does not arrive at the customer’s location as scheduled, the customer may choose either of the following options:
a) Cancellation with Refund: Upon customer request, the booking shall be cancelled and the customer shall be eligible for:
- 100% refund of the service/subscription fee, and
- 100% refund of the booking amount paid.
(The convenience fee shall not be refunded in this case).
b) Continuation of Booking: Alternatively, the booking may continue, and Cook Do Cook shall arrange to send the same cook or a replacement cook, subject to availability.
21.6. Refund on Termination Due to Repeated Cook Safety Concerns
Where the Company terminates a booking under Clause 10.11 pursuant to genuine safety, harassment, abuse, or misconduct concerns independently raised by two different assigned Cooks regarding the same household, the Customer shall be entitled to a refund of the unused portion of the Subscription Fee and the Booking Amount, calculated on a pro-rata basis as follows, subject to the applicable billing cycle under the Partial Payment Plan referred to in Clause 21.3, Scenario A:
- 30-Day Billing Cycle: If the booking is terminated on Day N of the cycle, Subscription Fee Refund = (Subscription Fee ÷ 30) × (30 − N); Booking Amount Refund = (Booking Amount ÷ 30) × (30 − N).
- 15-Day Billing Cycle: If the booking is terminated on Day N of the cycle, Subscription Fee Refund = (Subscription Fee ÷ 15) × (15 − N); Booking Amount Refund = (Booking Amount ÷ 15) × (15 − N).
For the avoidance of doubt: (a) the Convenience Fee and payment gateway charges shall remain non-refundable in all cases under this Clause; (b) taxes already remitted to the Government shall be refunded only to the extent permitted under applicable law; and (c) the day on which the booking is terminated shall be treated as a utilized service day for the purpose of this calculation.
21.7. General Provisions on Refunds
- Non-Refundable Components (All Plans): Notwithstanding anything to the contrary contained in this Agreement (except as explicitly stated in Section 4 for Failure to Assign), Convenience Fees and Platform Access Fees are strictly non-refundable under all scenarios.
- Final Authority and Discretion: Cook Do Cook reserves the right to approve, partially approve, or reject any refund request based on a reasonable assessment of the specific facts and circumstances of the case, made in good faith. The decision of Cook Do Cook regarding the eligibility for, and quantum of, any refund shall be final, and the Customer agrees not to dispute a decision made on this basis except on grounds of bad faith or manifest error.
These “Terms of Use” and “Cookdocook.com Privacy Statement” of Cookdocook.com site constitute a binding agreement between You and Cookdocook.com, and is accepted by You upon your use of the Cookdocook.com Site.
